Lack of regulations on imported cosmetics in India led to the proliferation of sub-standard and spurious cosmetics, worth millions annually. The Ministry of Health and Family Welfare in India has a compulsory registration certificate for importing cosmetic products in India to ensure safety.</p>\n<p>In India, all cosmetic products imported for sale need to be registered with the Central Drugs Standard Control Organization (CDSCO) as per the Drug and Cosmetics Rules 1945. Exemption from the new regulation and registration are those cosmetics products imported in India in bulk for re-packaging and re-processing and 100 percent export to other countries. However, bulk imports of cosmetics into India for re-packaging and sale in the Indian market are not exempted and need to be registered.</p>\n<h2>Who can apply for Registration of Importing Cosmetic products in India?</h2>\n<ol>\n<li>The Manufacturer himself has registered office in India.</li>\n<li>The Authorized Agent of the Manufacturer</li>\n<li>The Subsidiary of the Manufacturer</li>\n<li>Any other importer</li>\n</ol>\n<p>An &#8220;Authorized Agent&#8221; means a person or entity in India authorized by the manufacturer. Hydroquinone cosmetic market is a multibillion industry. They also are marketed worldwide for reducing age- related spots and blemishes in the skin. Research show some evidence in animals that hydroquinone may act as a carcinogen. However, its cancer-causing properties have yet to be proved in humans. Hydroquinone is also associated with a medical condition known as ochronosis in which the skin becomes dark and thick. Some studies even show the abnormal function of the adrenal glands in people who are using hydroquinone containing cosmetics. The toxic cosmetic products like bleaching creams, skin lighteners, pigment gels, spot treatments and many popular anti-aging products containing hydroquinone are being sold by rogue retailers, and online and at car boot sales and market stalls. Some scientific bodies hydroquinone as &#8220;the biological equivalent of paint stripper,&#8221; which removes the top layer of skin, increases cancer risk, and cause fatal liver and kidney damage.</p>\n<p>According to industry experts, many of these creams containing hydroquinone are not allowed to be sold in the developed world. Several countries including the US, Japan and Australia have either banned or imposed regulations on the OTC sales of hydroquinone products. Now, Government of India put a ban on Over-the-Counter (OTC) selling of hydroquinone, termed as Benzene 1,4-diol or quinol, a strong bleaching agent sold from April 1, 2019, as their unchecked usage can cause redness, inflammation and discoloration and in chronic health issues.</p>\n<p>Hydroquinone is a prescription drug all across the globe for a long. But in India, it was not a prescription drug. So, companies sell hydroquinone irrationally as an ingredient and sell it to anybody. You will need a doctor’s prescription to buy these products as per the law. The chemist cannot give hydroquinone-containing cream to anybody without a doctor&#8217;s prescription. Its usage can cause skin irritation, rash while over-use or long-term usage can damage the skin, which cannot be treated. However, earlier skin specialists have been using it to treat freckles, melasma, and general brown patching.</p>\n<p>The amendment to the Drugs and Cosmetics (D&amp;C) Rules of 1945 to bring hydroquinone containing creams under Schedule H will come into force on April 1, 2019. This is due to the Drugs Technical Advisory Board. Last year, the Ministry had placed all pharmaceutical formulations containing steroids for external use under Schedule H of the D&amp;C Act to stop their OTC sale. The regulatory system and advertising of cosmetic items ensuring safety and efficacy are the most imperative elements for the cosmetic industry&#8217;s development. The terminology, labelling, and safety of cosmetic products and colorant regulations are different for different nations. Cosmetic manufacturers have a legal responsibility to the consumers for the safety, quality, and labeling of their products. Sometimes safe cosmetics, when people use them in the right way, may be unsafe when used incorrectly. All cosmetic products must have some directions for use or warning labels so that people use them in the right manner. Some ingredients may be safe in cosmetic products such as cleansers that are immediately washed off the skin, but not for the products that we leave on the skin for long hours. Likewise, ingredients that are safe for use on the nails and hair can be unsafe when used near the eyes or on the skin. But as per law a cosmetic cannot contain any such ingredient that makes the product harmful when consumers use it as per label or in the customary or expected way.</p>\n<p>In India, the import of certain cosmetic products is prohibited as per Section 10 of the Drugs &amp; Cosmetics Act and Rules 134A, 135,135A of the Cosmetics and Drugs Rules, 1945 and the Bureau of Indian Standards (BIS). Under this law, cosmetics with Hexachlorophene (HCP) are prohibited from being manufactured and imported in India. This regulation came because HCP, a synthetic compound, has been associated with several hazards over the years. Recent studies showed that hexachlorophene can be absorbed through the skin into the bloodstream and that this absorption resulted in damage to the nervous system of infants. HCP has become a ubiquitous chemical since its discovery in 1939 and used in ENT products, medicated soaps, shampoos, foot powders, underarm deodorants, baby lotion, shoe liners, shower curtains, and wearing apparel in varying amounts.</p>\n<p>As per US FDA, HCP has toxic effect and ability to penetrate human skin, HCP can be used only in case no other preservative has shown effectiveness. As per the rule, the HCP concentration in a cosmetic may not exceed 0.1 percent, and it may not be used in cosmetics that are applied to mucous membranes, such as the lips. Such use of hexachlorophene shall be limited to situations where an alternative preservative has not yet been shown to be as effective or where adequate integrity and stability data for the reformulated product are not yet available.</p>\n<p>Antibacterial ingredients used as alternatives for hexachlorophene in cosmetic products must be adequately tested for safety prior to marketing. Studies show that it helps in the treatment of hair loss. Zinc pyrithione is the most acceptable antidandruff substance for curly hair because it leads to less drying and stiffness. Zinc pyrithione is derived from the chemical element zinc and releases zinc ions, which has anti- inflammatory and antioxidant properties. The Ministry of Health and Family Welfare in India has a compulsory registration certificate for importing cosmetic products in India to ensure safety.</p>\n<p>In India, all cosmetic products imported for sale need to be registered with the Central Drugs Standard Control Organization (CDSCO) as per the Drug and Cosmetics Rules 1945. Exemption from the new regulation and registration are those cosmetics products imported in India in bulk for re-packaging and re-processing and 100 percent export to other countries. Several factors contributing to the craze is the influence of the western culture, the increase in the purchasing power, desire to look attractive and beautiful etc.</p>\n<p>In India, there were no such strict regulations regarding the cosmetic products earlier. But due to the growing awareness, cosmetics is slowly coming under strict regulations. Presently, the governing legislation in case of cosmetics in India is the Drugs &amp;amp; Cosmetics Act, 1940.The procedure to be followed in order to manufacture cosmetics and getting cosmetic license in India has been laid down under the Drugs and Cosmetics Rules, 1945. Schedule M-II classifies cosmetics into 11 broad product categories like powders, creams, lotions emulsions, pastes, cleansing milks, shampoos, pomade, brilliantine, shaving creams, hair oils, nail Polishes and nail Lacquers, lipsticks &amp;amp; lip Gloss, depilatories, preparations used for eyes, aerosol, alcoholic Fragrance Solutions (Cologne), hair Dyes, tooth Powders and Tooth Pastes, toilet Soaps.</p>\n<h2><strong>How to apply for manufacturing license for cosmetics in India?</strong></h2>\n<p>The manufacture of cosmetics is regulated under a system of inspection and licensing by each state drug control department as per the provisions of Drugs and Cosmetics Act, 1940 and Rules. It varies from state to state. The application for a license is submitted though the website of each state in India. Some of the general requirements are as follows:</p>\n<ul>\n<li>Location and vicinity of the premises: Location of the area in which the factory or manufacturing facility of cosmetics and the surroundings is hygienic with proper sanitary conditions. No production should take place within or around a residential area.</li>\n<li>Building: The building in which the production is to be carried should be free from rodents, insects, etc. The height of the rooms of the building should be at least 6 feet from the floor. The construction of the building must be smooth, waterproof, and capable of being kept clean. So far, sunscreen is the main remedy to prevent the maladies inflicted by ultraviolet (UV) radiation. The prevalence of certain sun exposure-related pathologies like malignant melanoma, is also on the rise despite the continuously increasing frequency of sunscreen use worldwide. Yes, the sun’s rays do cause photo aging. But people are now smearing on themselves and their children sunscreen chemicals, SPF 2 to 50, without any idea of their safety. UV filters and their maximum allowable concentration are established by each country or union worldwide, for example, the European Union (EU), the United States of America (USA), Australia, Canada, ASEAN, and India. In the <a href=\"https://cliniexperts.com/cosmetic-regulatory-affairs/\">cosmetic regulation of India</a>, there is no fixed maximum SPF value for sunscreens.</p>\n<p>Worldwide experts are concerned that these chemicals may be absorbed through the skin, leading to irritation of skin, hormonal disruption and even skin cancer. The US FDA (Food and Drug Administration) recently called for more research on the safety and effectiveness of these cosmetic ingredients used as UV filters like benzophenone-3 (BP-3) or octocrylene in sunscreens.</p>\n<p>Octocrylene is an organic UV filter which absorbs mainly Ultraviolet B (UVB) radiation and Ultraviolet A (UVA) wavelengths. There is no research that shows UV filters are beneficial ingredients in cosmetics and protect from skin cancer. But octocrylene has been recently incriminated to potentially induce adverse effects on the endocrine system in addition to having allergic or photoallergic potential.</p>\n<p>According to Ruszkiewicz <em>et al.</em>, repeated topical octocrylene applications resulted in higher levels of urine and plasma. Once octocrylene is in the systemic circulation, it is transported to different organs. Octocrylene is highly lipophilic, and in rats, it has been detected in the liver and brain. High concentrations of BP-3 were also detected in adipose tissue after topical administration.</p>\n<p>On the other hand, in another safety review of octocrylene as an UV filter recently published in the <em>Journal of European Academy of Dermatology and Venereology </em>by Berardesca E <em>et al.</em>, octocrylene is considered as safe when used as a UV ﬁlter and cosmetic ingredients at a concentration up to 10%. These 12 ingredients are some of the most commonly used UV filters, such as oxybenzone, octinoxate, octisalate, octocrylene, homosalate and avobenzone.</p>\n<p>There are limited or no data on the absorption of the active cosmetic ingredients of sunscreen. In 2019 and 2020, FDA published two studies that shows the ingredients oxybenzone, octinoxate, octisalate, octocrylene, homosalate and avobenzone are all systemically absorbed into the body after a single use (Matta 2019, Matta 2020). The FDA also found that the sunscreen ingredients could be detected on the skin and in blood weeks after application ended (Matta 2020).</p>\n<h3><strong>The bottom line</strong></h3>\n<p>There is a need for detailed investigation of the safety of all sunscreen ingredients by the FDA, and more research studies to ensure that none of them damages skin or cause other toxic effects.
